The supposed target: cannabis grow operations. But the threshold for "suspicious" usage kept dropping. In 2014, SMUD flagged homes using 7,000 kWh per month. By 2023, the threshold had fallen to just 2,800 kWh, well within normal range for a large family or home office. [2]
The Fines and the Racial Disparity
Sacramento Police began issuing massive penalties under a city ordinance allowing fines for properties where cannabis was found. In just two years, they levied nearly $100 million in fines. [2]
The racial breakdown: 86% of those penalties went to people of Asian descent. [2]
In November 2025, a court ruled the program unconstitutional. The EFF won a landmark decision declaring that "dragnet surveillance (suspicionless searches of entire zip codes worth of customer energy data) is inherently unreasonable" under California's constitution. [3]
